INFORMATION ABOUT PRIVACY

Italian Legislative Decree no.196 dated 30 June 2003 (Law on Privacy and Data Protection)

In accordance with article 13 of the above-mentioned decree, we inform that Base Hotels Group srl processes common personal data that customers, suppliers and subjects have voluntarily communicated directly or by phone or by post or by fax or by e-mail to our commercial office or to the company proving us telemarketing services.

As guaranteed by the foresaid law (rif. Art. 2 – Finalità), Base Hotels Group srl guarantees that personal data are processed in respect of fundamental freedoms and rights as well as dignity of the person concerned, with specific regard to confidentiality, personal identity and the right to personal data protection.

Purpose of data processing

All data communicated by concerned subjects are exclusively processed to carry out obligations connected to the company’s economical activity, such as products and services supply, requested, in particular to insert records in the company’s computer database; to process internal statistics; to register maintenance sheets for assistance and/or development; to issue shipping documents, invoices and credit notes; to send quotations and offers to active and/or potential customers; to send requests of quotations to active and/or potential suppliers; to keep accounting books; to handle cash and payments; to send technical and/or commercial information (advertising material, promotions, accounting and fiscal communications and not) regarding one’s own activity to active and/or potential customers; to exchange communications regarding the economic, administrative and commercial company’s activity by telephone, mail, fax, email and Base Hotels group srl website private areas; to fulfil obligations provided for by laws or regulations in force, of Community legislation, including fiscal matters.

Data communication and circulation

Personal data of persons concerned, if necessary, could be communicated to: all subjects allowed to access by law regulations; our consultants, employees, agents and suppliers performing relevant tasks and/or possible contractual obligations with them, relevant to commercial relationship with persons concerned; factoring societies, credit recovery societies, credit insurance societies; companies that produce and/or grant licenses to use any services/products supplied, only when the communication is necessary for the use of the services/products purchased by the interested party; post offices, shipping agents, couriers for documentation and /or material shipping; suppliers of Unified Messaging services via the Internet, when this channel is used to send letters and messages to interested parties; all those public and/or private subjects, natural persons and/or legal entities (legal, administrative and fiscal consultancy professionals, labour consultants for pay slips’ compilation, Legal Offices, Chambers of Commerce, Labour Chambers and Offices, etc) when the communication is necessary or functional to the carrying out of our activity and in the ways and purposes mentioned above; banks for cash and payments’ handling deriving from contracts fulfilment and other subjects needed to implement the service.

For those who intend to open a commercial relationship with our company, even if purely for the purpose of obtaining information about our activities/services, providing personal data is optional; however, a failure to provide the information could make it impossible to continue the relationship, conduct it properly or fulfill legal and even tax obligations. The data are kept at our company’s operating headquarters for the time required by civil and tax regulations.

Methods of data processing

Personal data processing is only held by Base Hotels Group srl headquartes and shall be carried out using both hard copy and electronic files, using both the telephone and computers and even through authorized tools for the storage, handling and transmission of the data, with the observance of each possible precautionary measures, in order to grant safety and privacy.

Right of personal data access

The user has the right to obtain confirmation of the existence of personal data that regard him even if they have not yet been recorded, with communication in an understandable form.

The user has the right to know the source of the personal data; the purposes for and method of data processing and storage; the logic applied when data is processed with the aid of electronic instruments; the identifying details of the owner, the direct or and his assistants in accordance with article 5, comma 2; the persons and groups of persons to whom the personal data can be communicated or who may come to know due to their position as designated representative, responsible or in charge, in the territory of the Country.

The user has the right to request the revision, rectification or when he desires, completion of data; the cancellation, transformation into an anonymous form or blocking of data which was processed in violation of the law, including that which was not necessary to store for the purposes for which the data was collected or later processed.

The user has the right to withhold consent, wholly or in part, for the processing and storage of data that regard him even though they may be pertinent to the purpose of data collection, for legitimate reasons; for the processing and storage of personal data with the purpose of sending advertising material or for direct sales, market research or commercial information.

The rights referred above may be exercised by making a request to the data controller or processor without formalities, also by the agency of a person in charge of the processing. A suitable response shall be provided to said request without delay. The request addressed to the data controller or processor may also be conveyed by means of a registered letter, facsimile or e-mail.

Article. 7 of the Legislative decree n. 196 of 30 June 2003
(Right of access to personal data and other rights)

1. The user has the right to obtain confirmation of the existence of personal data that regard him even if they have not yet been recorded, with communication in an understandable form.

2. The user has the right to know the following:

a) the source of the personal data;

b) the purposes for and method of data processing and storage;

c) the logic applied when data is processed with the aid of electronic instruments;

d) the identifying details of the owner, the direct or and his assistants in accordance with article 5,

comma 2;

e) the persons and groups of persons to whom the personal data can be communicated or who may come to know due to their position as designated representative, responsible or in charge, in the territory of the Country.

3. The user has the right to request the following:

a) revision, rectification or when he desires, completion of data;

b) cancellation, transformation into an anonymous form or blocking of data which was processed in violation of the law, including that which was not necessary to store for the purposes for which the data was collected or later processed;

c) proof that the operations a) and b) above were brought to the notice of those responsible for action, as well as to those to whom the data was communicated or given, except in the case where this is impossible or requires the use of manifestly disproportionate means with respect to the rights being safeguarded.

4. The user has the right to withhold consent, wholly or in part:

a) for the processing and storage of data that regard him even though they may be pertinent to the purpose of data collection, for legitimate reasons;

b) for the processing and storage of personal data with the purpose of sending advertising material or for direct sales, market research or commercial information.

WEBSITE SECURITY MEASURES

For the website management specific security measures have been adopted, designed to ensure secure access for users and to protect the information contained in the site from the risk of their loss or destruction, whether by accident or not, and from unauthorized access to the data or from processing operations that are either unlawful or inconsistent with the purposes for which the data have been collected. The antivirus software used in the management of the site is updated periodically in order to avoid loss of data due to the action of viruses. Access to the any confidential parts of the site may be given to companies or physical persons who request an identification code and password. These passwords are directly communicated to the user(s) and it is his own responsibility to keep the password confidential.
